@List understands and respects your concerns about privacy. At the same time, we do ask that you provide information about yourself in order for us to understand your needs better and make your experience at @List more valuable to you. We created this Privacy Policy to provide you with notice of what information @List may collect how such information may be used or shared with third parties, and how such information relates to the operation of the Site. This Privacy Policy is subject to the Terms and Conditions of Use (the "TCU") posted on the Site, including the provisions regarding change or modification of this Privacy Policy and other policies as set forth in the TCU. You are responsible for checking this page frequently for changes and updates to the Privacy Policy. Your use of the Site following any posted changes to the Privacy Policy will be deemed an acceptance of such changes. This Privacy Policy is part of, and incorporated into, the TCU.
The Site is not intended for use by persons under the age of thirteen. Individuals who are under the age of thirteen are expressly prohibited from submitting to @List or posting to the Site any personally identifiable information about themselves.
By providing any personal information to this Site, you fully understand and unambiguously consent to the collection and processing of such information in the United States and/or any other country.
1. What personally identifiable information @List collects from you, and how @List uses the information.
@List collects and stores personal information in several ways at different parts of our Site. This information may include your legal name, company legal name, email address, company age, address, telephone number(s), areas of interest, financial information, User ID, User Password and other self-identifying information. We collect this information in order to provide you with our services more easily, and in a more personalized manner. We may make message boards and discussion forums available to you. If you choose to voluntarily disclose certain information on any such public area of the Site, this Privacy Policy will not cover such disclosure of information. We urge exercising caution when disclosing information on public message boards or discussion forums.
@List also may request certain information using online order forms for products and services. On the order forms, we may collect contact information, financial information, demographic information, method of payment and, if applicable, a credit or debit card number. We may also collect information about you in surveys or for sweepstakes and contests on the Site and information about the searches you perform and the pages you visit on the Site. @List may also monitor, on an anonymous aggregate basis, patterns of use in connection with emails that it sends out, including which links are clicked on in our email communications, so that we may use such information to better personalize the content of the Site and our mailings for our users. All such information will be protected in accordance with our Privacy Policy. We may also automatically collect your Internet Protocol address to help diagnose problems and for system administration. @List reserves the right to request any additional information necessary to establish and maintain your account for use of the Site.
@List uses the information collected from you in accordance with this Privacy Policy. Information we collect is used to customize your experience at our Site. We also show you content that we think will be interesting to you, and display content according to the preferences you indicate while on our Site. @List may use your information to send you promotional materials about @List and its partners. We may also use your information to contact you, if necessary.
2. With whom your information may be shared.
@List uses the information described above to tailor our content and help our advertisers and third party marketers better understand the demographic profile of our Site’s users. This is essential to keep the costs of our products and/or services reasonable. The personally identifiable information that you submit to remains your property, however, by submitting that information to @List you grant @List the right to use that information as set forth herein. We may use your personal information and/or transfer the personal information you supply on the Site to other third party businesses, subject to applicable state and federal law, for any legal purpose including, without limitation to: (a) bring selected retail opportunities and promotional offers to you via direct mail marketing, e-mail marketing, telemarketing and/or online banner advertising; (b) when necessary, to receive a product or service that you may have ordered from such third party while using the Site or when responding to offers provided by @List; (c) tracking compliance with our @List Website Terms and Conditions of Use (TCU); and (d) for validation, suppression, content improvement and feedback purposes. These third party businesses may include providers of direct marketing services and applications, including look up and reference, data enhancement, suppression and validation and e-mail marketing. We, or these third party businesses, may, from time to time, supplement the information we collect online with outside records (e.g., information from such third party businesses or other entities) to enhance our ability to serve you, to tailor our content to you and to offer you targeted advertising and other opportunities to purchase products or services that we believe may be of interest to you. By permitting to collect this information, you will be able to receive free information on products and services that may be of interest to you. We use contact information collected from our Site to send you information about us, to keep you informed of products and services that may be of interest to you, as well as to service your account with us should you place an order. In addition, you agree that we may contact you with updates and/or any other information that we may deem appropriate for you to receive in connection with your account and/or the Site.
We also use this information to personalize your experience with @List. Contact information is also used to reach you, when necessary, regarding the use of our Site, products and/or services. By submitting your e-mail address at the Site, you agree to receive e-mail marketing from @List and our third party advertisers. @List, and our third party advertisers, may maintain separate e-mail lists for different purposes. If you wish to end your e-mail subscription to a particular list, you must follow the instructions contained in each e-mail correspondence that you receive from @List or the applicable third party advertiser to unsubscribe from that particular list. We only send e-mail marketing to individuals that have agreed to receive e-mail from @List and to individuals that have otherwise agreed, on third party websites, to receive e-mail marketing from other companies, such as @List. @List does not send unsolicited commercial e-mail. As a result, certain statutes requiring particular formatting for unsolicited commercial e-mail may not be applicable to the commercial e-mail that is sent by @List. Notwithstanding the foregoing, we will not send you any e-mail marketing, or allow any third party to send you e-mail marketing, from which you cannot unsubscribe.
You may choose to stop receiving future communications regarding products and services we may offer to you (see the "Opt-Out/Unsubscribe" section below), however we may be required to contact you thereafter regarding any order or purchase that you may make while on this Site.
In addition, you agree that by submitting your e-mail address at the Site and/or registering for the products and/or service offered herein, such act constitutes a purchase, an inquiry and/or an application for purposes of the Amended Telemarketing Sales Rule, 16 CFR '310 et seq. (the ATSR) and any applicable state and local do-not-call regulations. Notwithstanding that your telephone number may be listed on the Federal Trade Commission's Do-Not-Call List, or an applicable state do-not-call list, @List retains the right to contact you via telemarketing in accordance with the ATSR and the applicable state regulations. Moreover, by registering with, or requesting information from, a third party advertiser at or through the Site, such action shall constitute a purchase, an inquiry and/or an application with the respective third party advertiser for purposes of the ATSR and any applicable state and local do-not-call regulations and you may be contacted via e-mail, direct mail and/or telemarketing by such third party advertiser in accordance with the ATSR and the applicable state regulations.
@List does not control, and is not responsible for, the practices of our advertisers or third party marketers. We will never disclose any credit card or other financial information to any third-party marketers or other non-governmental entity. Notwithstanding the foregoing, we may: (a) share the fact that we have credit card information on file for specific users of the Site but we will not share your specific credit card information with such third parties without your prior informed consent; (b) share your credit card information with consumer credit agencies; and (c) disclose your credit card information and/or financial information to third party processors for the sole purpose of effectuating transactions that you enter into at the Site. We may also disclose your personally identifiable and/or financial information: (a) to a governmental entity if so ordered by a court of law, to comply with the local, state and federal laws (b) where otherwise required by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or comply with a legal process served on our Site; or (c) if we are sold or acquired.
If payment is made for any of our products and/or services by check, and such payment is subsequently dishonored by the bank from where the check is drawn, @List reserves the right to resubmit the payment electronically either directly or through a third-party payment and/or collection service. You agree that you are responsible for any and all fees pertaining to a returned payment, regardless of the reason. The Returned Check Fee is currently US$25.00 for each occurrence, and will be added to your account. Any order not paid due to returned payments after a reasonable period of time will be considered fraudulent and will be turned over either for collection and/or subsequent prosecution.
Site as an Agent
Please be advised that in certain circumstances, we act as a limited agent for certain third party partners, including the actual third party provider of some of the products and/or services available at or through the Site. In these circumstances we will collect and send your personal information to the respective third party partner directly and you will be subject to the third party partners privacy policy. In order to provide you with co-branded services, and to improve our features, we will sometimes share your information with our partners.
We reserve the right to disclose any information if such action is necessary (a) to conform to the requirements of the law or to comply with legal process or subpoena served on @List, (b) to protect and defend the legal rights or property of @List, the Site, or its users, or (c) in an emergency, to protect the health and safety of its users or the general public. We further reserve the right to release any information concerning any user if that user participates (or is reasonably suspected of participating) in any illegal activity, even without a subpoena, warrant, or other court order. We cooperate with law enforcement agencies in identifying those who may be using our servers or services for illegal activities. We also reserve the right to report any suspected illegal activity to law enforcement for investigation or prosecution.
It is possible that @List, its subsidiaries, its joint ventures, or any combination of such, could merge with or be acquired by another business entity. Should such a combination occur, you should expect that @List would share some or all of your information in order to continue to provide the service. Notice of any such event (to the extent it occurs) will be posted on the @List website, and we will require that the new combined entity follow the practices disclosed in this Privacy Policy.
3. What choices you have regarding the collection, use and distribution of your information.
You may occasionally receive information about the products or services you have selected to place on your personal @List pages, which may include @List products and services, and the products and services of our partners. @List believes that these updates are interesting and informative. In the event you are requested to register, you may be given an opportunity to "opt in" to receive mailings from @List and/or its partners by "checking" a box in the registration form. (For purposes of this Privacy Policy, "partners" includes, in addition to third parties with whom @List may have co-branding arrangements or some other business relationship or alliance, other web sites incubated or funded by eCompanies, as such term is defined below.) If you submit a registration form with the box checked, you thereby consent to being placed on this mailing list. You may subsequently contact us to request to be removed from this list. In every update that we send, we may include an option to discontinue receipt of future updates. @List reserves the right to limit any registrations on our Site to those who will accept our information and to those who will provide the requested information.
4. What cookies are, and how @List uses them.
As part of offering and providing customizable and personalized services, @List uses cookies to store and sometimes track information about you. A cookie is a small amount of data that is transferred to your computer's hard drive. All portions of the Site that prompt you to log in or that are customizable require that you accept cookies. No other company has access to cookies placed on your computer by @List unless you select the option, upon registering with the Site, to share user-information with @List's partners. We may use cookies technology to reduce the time required for you to submit your requests and for @List to respond to such requests. Cookies will not be used by us to retrieve any information about you, or from your computer, that you have not voluntarily given to us. 5. How @List protects your personal information.
For all our transactions, we employ reasonable and current Internet security methods and technologies. Where appropriate, we password protect, use encryption techniques and install firewalls. We strive to protect you. We encourage our participating service providers to adopt and honor their own consumer privacy policies. For all our efforts to safeguard your privacy, no system can be guaranteed. We cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free from unauthorized access by third parties. Once we receive your information, we use reasonable efforts to ensure its security on our systems.
6. How you can access, update or delete your information.
As part of your use of the Site, you are responsible for maintaining and updating, as applicable, your account Registration Data with current, accurate and complete information. You may view, update and/or edit the Registration Data you have provided to @List by logging in to your account and following the appropriate instructions.

The Site may also contain links to other web sites and advertising. The privacy policies of those web sites and advertisers may significantly differ from that of our Site. It is your responsibility to contact such web site operator or advertiser directly to determine their privacy policy.
